California Overtime Law Breakdown

California has some of the strictest overtime mandates in the United States. Unlike federal law which only counts weekly hours, California requires daily overtime calculation:

1.5x Overtime

Hours worked beyond 8 up to 12 in a single workday, and the first 8 hours on the 7th consecutive day of work.

2.0x Double Time

Hours worked beyond 12 in a single workday, and all hours worked beyond 8 on the 7th consecutive day.

Weekly 40-Hour Limit

Any hours worked beyond 40 regular hours in a standard workweek are paid at 1.5x.

Frequently Asked Questions

Does an employee get double time for working on weekends in California?

Not automatically. Weekend hours are treated like regular workdays unless they exceed 8 or 12 daily hours, or constitute the 7th consecutive day of work in that workweek.

Can an employee waive daily overtime in California?

No. Overtime pay is mandatory by California Labor Code Section 510 and cannot be waived through personal agreement or employee request.
